These Terms of Service ("Terms") are a binding agreement between you ("you") and Naturalpen ("Naturalpen," "we," "us," or "our"). They govern access to and use of the Naturalpen website, applications, and related services (collectively, the "Services"), including our AI-assisted text humanizer and subscription offerings.

By accessing or using the Services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Services.

Additional policies or product-specific terms may apply and are incorporated by reference. We may update these Terms; the "Last updated" date above will change. Your continued use after updates constitutes acceptance of the revised Terms, to the extent permitted by law.

The Services are intended for users who are at least 18 years old. You may not register or use the Services if you are under 18.

1. Our services

Naturalpen provides tools to help rewrite and refine text using automated and AI-assisted processing. Output is generated algorithmically and may be imperfect; you are responsible for reviewing and using it appropriately.

The Services are not tailored to satisfy industry-specific regulations (such as healthcare, legal, or financial compliance). If your use would require such compliance, you must not rely on the Services as a substitute for professional advice or regulated tools.

If you access the Services from other jurisdictions, you are responsible for compliance with local laws.

2. Intellectual property

We own or license the Services, including software, design, branding, and related materials ("Naturalpen materials"). Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes in accordance with your plan.

You may not copy, modify, distribute, sell, or reverse engineer Naturalpen materials except as expressly allowed by law or with our prior written consent.

3. Your representations

You represent and warrant that:

• Information you provide is accurate and kept up to date.
• You have legal capacity to agree to these Terms.
• You meet the age requirement above.
• You will not use unauthorized bots, scrapers, or automation to access the Services without permission.
• Your use of the Services complies with applicable law.

We may suspend or terminate access if information is false or if you breach these Terms.

4. Accounts and security

Certain features require registration. You are responsible for safeguarding credentials and for activity under your account. Notify us promptly of unauthorized use. We may reclaim or change usernames that violate these Terms or applicable law.

5. Subscriptions, billing, and usage

Paid plans (for example Naturalpen Basic and Naturalpen Premium) and free-tier allowances are described on our pricing page and in your account. Fees are charged in the currency shown at checkout. Taxes may apply. You authorize us and our payment processor (Stripe) to charge your payment method for amounts due.

Subscriptions renew automatically until canceled through your billing settings or the Stripe customer portal where available. We may change prices or features with reasonable notice where required; changes typically apply on renewal.

Free and paid plans may include monthly word or usage limits. Misuse of free tiers (including creating multiple accounts to evade limits) may result in suspension or additional charges.

6. Cancellations and refunds

You may cancel a subscription in accordance with the cancellation tools we provide. Cancellation stops future renewals; it does not automatically refund amounts already charged unless required by law or expressly stated at purchase.

Because the Services deliver digital functionality and incur processing costs when used, fees are generally non-refundable except where mandatory consumer rights apply in your jurisdiction. Nothing in these Terms limits rights you may have under applicable law.

7. Your content

You retain ownership of text and materials you submit ("Your Content"). To operate the Services, you grant Naturalpen a worldwide, non-exclusive license to host, process, transmit, display, and create derivative outputs (for example humanized text) solely to provide, secure, and improve the Services—consistent with our Privacy Policy.

You are responsible for Your Content and represent that you have the rights needed to submit it. Do not submit unlawful, infringing, or harmful material.

8. Prohibited conduct

You agree not to:

• Violate law or third-party rights.
• Attempt to probe, scan, or test vulnerabilities; bypass security; or access data you are not authorized to access.
• Use the Services to generate or facilitate harassment, fraud, malware, spam, or illegal content.
• Resell, sublicense, or commercially exploit the Services without agreement.
• Use automated means to extract bulk data or overload our systems without permission.
• Misrepresent affiliation with Naturalpen or others.

We may remove content or suspend access for violations.

9. Third-party services and links

The Services may link to or integrate third parties (for example payment, sign-in, or hosting). Their terms and privacy policies apply when you use them. We are not responsible for third-party content or practices.

10. Privacy

Our Privacy Policy explains how we collect and use personal data. By using the Services, you acknowledge that policy.

11. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, Naturalpen disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or that outputs will meet your requirements or be suitable for any specific use.

12. Limitation of liability

To the maximum extent permitted by law, Naturalpen and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or similar losses, arising from your use of the Services. Our aggregate liability for claims relating to the Services will not exceed the greater of (a) the amount you paid to Naturalpen for the Services in the twelve (12) months before the claim, or (b) fifty U.S. dollars (USD $50), except where such limitations are prohibited by law.

13. Indemnification

You will defend, indemnify, and hold harmless Naturalpen and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of Your Content, your use of the Services, or your breach of these Terms, except to the extent caused by our willful misconduct.

14. Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or for operational reasons. Provisions that by nature should survive (including intellectual property, disclaimers, limitations, indemnity, and governing law) will survive termination.

15. Changes and availability

We may modify, suspend, or discontinue features or the Services with or without notice. We are not liable for any modification, suspension, or discontinuance.

16. Governing law

These Terms are governed by the laws applicable in the jurisdiction where Naturalpen operates, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country or state of residence require otherwise.

17. Dispute resolution

Before filing a claim, you agree to contact us at support@naturalpen.com and attempt to resolve the dispute informally for at least thirty (30) days. If informal resolution fails, disputes may be brought in the courts that have jurisdiction under applicable law. Nothing in these Terms limits non-waivable rights you may have as a consumer.

18. Electronic communications

You consent to receive communications electronically (including billing and service messages). Marketing communications are subject to your choices and our Privacy Policy.

19. Miscellaneous

These Terms, together with the Privacy Policy and any additional terms we post, constitute the entire agreement regarding the Services. If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
